Umweltrecht und -politik in Mehrebenensystemen

Das Institut widmet sich seit 2010 auch dem Forschungsschwerpunkt „Umweltrecht und -politik in Mehrebenensystemen“, da Umweltfragen alle Regierungsebenen – von lokal bis international – betreffen. Im Mittelpunkt der momentanen Forschungsarbeiten steht die Frage, ob und in welcher Form Umweltschutz bzw. der Schutz und das nachhaltige Management von Naturressourcen auf diversen Regierungsebenen und in verschiedenen Rechtssystemen gewährleistet sind.

Der Fokus der bisherigen Forschung lag (hauptsächlich) auf folgenden Themen:

Auswirkungen des EU-Umweltrechts auf die italienische Gesetzgebung (auf die nationale und die regionale/Provinz-Ebene), Kompetenzverteilung zwischen nationaler Ebene und den Regionen/Provinzen mit Sonderstatut (darunter Südtirol), Management und Schutz von Wasserressourcen, Bürgerbeteiligung in Entscheidungsfindungsprozessen zu Umweltthemen, Schutz der Biodiversität und ecological connectivity, Verbesserungsmöglichkeiten und Harmonisierung von low-carbon Politik und Strategien.

Neben der Grundlagenforschung, führt das Institut durch Drittmittel (EU sowie Autonome Provinz Bozen/Südtirol) geförderte Projekte und Beratungsaufträge aus.

Die Forschungsarbeiten können daher in folgende sechs Unterkategorien unterteilt werden:

(1) Governance in Mehrebenensystemen

(a) Umweltschutz in Mehrebenensystemen

(b) Die Auswirkungen von EU-Recht auf die Autonomie Südtirols (2013-2015)

(2) Verfassungsreformen und Autonomiestudien

(a) Die Kompetenzverteilung zwischen nationaler Ebene und der Autonomen Provinz Bozen/Südtirol (2014-2015)

(b) Analyse der Auswirkungen der italienischen Verfassungsreform auf Umweltzuständigkeiten - im Rahmen des Projekts: Italienische Verfassungsreform 2015/16.

(c) Wissenschaftliche Untersuchung der Zentralisierunsgtendenzen im Bereich der Umweltpolitik im Vereinigten Königreich nach dem Brexit (laufend)

(3) Wasser-Governance

(a) Wasser-Governance in Italien und die Nachhaltigkeit der Wasserressourcen

(b) Report für die Universität Trient zur Wasser-Governance (2016)

(c) Beratung für die Weltbank zum Thema der Wasserpolitik in Italien im Rahmen der jährlichen Publikation „Enabling the Business of Agriculture“(2018)

(4) Erneuerbare Energien und Klimawandel

(a) Low carbon South East Europe LOCSEE (2013-2014)

(b) Verbesserung der Umweltleistung und des Klimawandels von Infrastrukturinvestitionen in der westlichen Balkanregion aus Sicht der EU-Integration (2017-2019)

(5) Partizipative Demokratie
