Environment

Legislazione e politica ambientale in sistemi multilivello

    L’area di ricerca “Diritto e politiche ambientali in sistemi multilivello” è stata inaugurata nel 2010. Il lavoro dell’Istituto in quest’ambito parte dal presupposto che i problemi ambientali possono avere una dimensione locale, nazionale e transnazionale. In questo contesto, si indaga su come la gestione e la conservazione delle risorse naturali e la protezione dell’ambiente siano garantite ai diversi livelli e, in prospettiva comparata, in diversi ordinamenti.

    I principali temi finora affrontati sono: l’impatto della legislazione ambientale europea sull’ordinamento italiano, a livello nazionale e regionale/provinciale; la ripartizione delle competenze legislative tra lo Stato italiano e le Regioni/Province autonome; la gestione e la protezione delle risorse idriche; la partecipazione pubblica nelle procedure decisionali in materia ambientale; la protezione della biodiversità e la connettività ecologica; il miglioramento e l’armonizzazione delle politiche e strategie “low carbon”.

    Oltre alle attività di ricerca di base, l’istituto collabora e porta avanti progetti e consulenze finanziate da fondi terzi (UE e Provincia autonoma di Bolzano).

    Il lavoro dell’Istituto in quest’area può essere suddiviso nelle seguenti sotto-categorie strategiche:

    (a) La protezione multilivello dell’ambiente (in corso)

    (b) L’impatto della legislazione europea sulla Provincia autonoma di Bolzano/Bozen (2013-2018)

    (2) Riforme costituzionali e autonomie

    (a) Rapporto di consulenza per la Provincia autonoma di Bolzano/Bozen sulla ripartizione delle competenze in materia di ambiente tra Stato e Regioni (2014-2015)

    (b) Ricerca sulle implicazioni della riforma costituzionale italiana sulla competenza in materia di ambiente per le Regioni speciali

    (c) Ricerca sulle tendenze di centralizzazione concernenti le politiche ambientali nel Regno Unito a seguito della Brexit (in corso)

    (3) Governance delle risorse idriche

    (a) La governance delle risorse idriche e la sfida della sostenibilità (2010-2011)

    (b) Rapporto di consulenza per l’Università di Trento sulla governance delle risorse idriche (2016)

    (c) Consulenza per la Banca Mondiale sulle politiche idriche italiane nell’ambito della pubblicazione annuale "Enabling the Business of Agriculture" (2018)
